Mokam Limited (“Mokam”, "we", "us" or "our") owns and operates the DAS (“Distribution as Service”) App, comprising a digital platform for wholesale shopping. This Policy outlines our practices regarding the collection, usage, maintenance, and protection of your information through our web and mobile applications-related services (“DAS Platform”). We will inform you about significant changes via our app or website. Your continued usage of the DAS App signifies your agreement to these terms.
This privacy policy (“Privacy Policy”) forms an integral part of the Terms of Service between Mokam and You, as a user of the platform (alternatively “Users”, or the grammatical variations of “You”), and governs how Mokam collects, uses, shares, and protects Your personal information. Accordingly, You are advised to read this Privacy Policy carefully before accessing the DAS App/Platform.

User Provided Data: Your name, phone number, email ID, address, location, password, and images as provided by You at the time of creating Your account on the DAS Platform (“User Account”).
Transaction Data: transaction details relating to payments made on the DAS Platform, which is required for banking and payment related activities. (which shall be masked or secured as mandated under applicable law).
Image Collection: Shop Images for verifying the existence of the shop of the User
Image & File Upload (Camera and File system access): The following will be collected:
Image while doing registration
Uploads of the images of the receipts while receiving goods from You.
Images of deposit slips while making financial deposits.
DAS App collects and stores images of the shops to verify the physical presence of these businesses, by cross checking them with the uploaded images:
To confirm the physical presence of shops within the DAS App, users are requested to upload pictures of their shops. These images are securely collected and stored only to verify the shop's existence. We assure You that the images are treated with strict confidentiality and will not be used for any other purpose. We value your privacy and are committed to the responsible handling of this data.
Images of Deposit Slip for Verifying the Deposit information:
DAS App collects and stores images of deposit slips to confirm bank transactions, specifically when users upload these images.
As part of our transaction verification process in the DAS App, users are requested to upload images of their deposit slips. The purpose of this is to verify that the deposit has been made. Please note that the DAS App uses these images solely for this verification purpose. We understand the importance of security and privacy of Your financial data, and therefore, we store this information securely. Rest assured; we do not use it for any other purposes than the intended verification.
Proof of Delivery Receipts Image Upload for Verifying the Receipt:
DAS App collects and stores images of proof of delivery (POD) receipts to enable the verification of transactions, specifically when Users upload these images.
In the DAS App, to ensure the authenticity of transactions, users are required to upload images of their proof of delivery (POD) receipts. These images are collected and stored by the DAS App for the sole purpose of transaction verification. We are committed to maintaining the confidentiality of this data and will not use it for any other purpose without your explicit consent.
User Activity Data: we collect data pertaining to Your use of the DAS Platform, in the following manner:
Analytics Information: we may collect information relating to user visits, browser types, referring/exit URLs, domain names, landing pages, and the information sent by Your device to us when You interact with the DAS Platform.
Cookies and similar technologies: we may use cookies and similar technologies like pixels, web beacons, and local storage to collect information about Image & File Upload (camera and File System Access), location, notification, storage (shared preference). This also includes monitoring Your browser type, app usage, duration, and location data, helping us understand Your preferences and improve our service delivery.
Browser fingerprint: we may collect information about Your browser version, program language, and individually installed plug-ins (i.e., small programs or program extensions). Browser providers or installed plugins can retrieve this information in order to, for example, inform You when new software is available to you. These ‘fingerprints’ enable us to identify you when you are trying to make a purchase.
Information regarding your Live Location and Location Data;
Information from your Device's SIM Card (phone number);
Pictures and other information from Your Device's camera and photo library for the purposes specified above;
Some of the information You are required to provide on first accessing or registering on the DAS Platform is mandatory and essential to the provision of facilitating payments to access digital goods; if you do not provide such mandatory information, you may not be able to access some of the features of the DAS Platform.
Location: When you register the as an DAS with our system, we will record the location of the DAS shop.
Notification: Push and In-App notifications to provide you with the latest updates.
Storage: To store a copy of the data pertaining to the usage of this App.
How we use your information:
In addition to the uses of information we describe elsewhere in this Privacy Policy, we use your information to do the following:
Enable your access to and use of the DAS Platform;
Facilitate transactions with third parties on the DAS Platform and for the purchase of goods or services from such third parties;
Identify the devices used to access digital goods purchased via DAS Platform;
Identify your preferences in, and send you personalized recommendations for goods and services from third parties;
Send you DAS Platform-related communications (e.g., account verification, changes/updates to features of Mokam, technical and security notices, subscription status, account reminders, newsletters, recommendation of digital goods);
Send you special offers on other products and services we think you might like;
Handle support requests from users and third-party service providers/sellers;
Settlement of payments due to the third-party service providers/sellers;
Perform internal operations such as troubleshooting, data analysis, testing, research, analytical, and statistical purposes aimed at improving the DAS Platform by making it more intuitive and personalized. Such analysis is aggregated and does not pertain to any specific User;
Enforce our Terms of Service and Privacy Policy.
How we store your information:
The user information collected by us is securely stored and processed on servers located in Google Cloud Services. It is possible that our service providers, employees, and consultants located in other jurisdictions may have access to your information; we ensure that such persons are bound by strict confidentiality obligations to ensure the security of Your information.
Some of our Affiliates and/or Service Providers may store or process information in jurisdictions other than Bangladesh or India; these parties are contractually bound to ensure the protection of user information in compliance with applicable laws.
How we share your information:
We may share your information with the following entities:
third-party sellers on the DAS Platform; and
third-party organizations that help us provide DAS Platform to You, including payment service providers, cloud storage providers, hosting providers, and analytics providers ("Service Providers").
Our Service Providers are bound by data processing agreements that require them to take sufficient technical and organizational measures to safeguard Your information.
We may share Your information with businesses that are part of the same group of companies as Mokam ("Affiliates") that aid us in the provision of the DAS Platform, and for our internal business purposes.
We may share your information with law enforcement agencies, public authorities, or other organizations or if such use is reasonably necessary to:
comply with any legal obligation, process, or request from government or judicial authorities;
enforce our Terms of Service and Privacy Policy, including investigation of any potential violation thereof;
detect, prevent, or otherwise address security, fraud, or technical issues with the ShopUp Platform; or
protect the rights, property or safety of Mokam, our users, third parties, Affiliates, Service Providers, or the public in general as required or permitted by law (including exchanging information with other companies and organisations for the purposes of fraud protection).
If we sell or otherwise transfer our business or our assets, in full or part, to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, or liquidation), Your information may be among the items sold or transferred. The buyer or transferee would be obligated to honour the commitments made in this Privacy Policy.
How long we retain your information:
We retain your information till such time you continue to use the DAS Platform or the time it is necessary to provide you with the DAS Platform; thereafter, we may retain your information to comply with legal obligations, resolve disputes, enforce agreements, and protect Mokam’s legal rights, subject to limitations under applicable law.
If you request the deletion of your account with us, we will delete all your personal information within 7 working days; however, we may retain your information in a pseudonymized form thereafter.
User rights:
Access: You may view your User-Provided Data by logging in to your User Account. Additionally, you may make a request by writing to us at hello@shopup.org to provide you with a copy of your personal information available with us and the ways in which your personal information has been used or disclosed by us within the previous year, subject to applicable law.
Correction: You may correct the personal information that you have provided to us by logging into your User Account, and using the options available therein.
Withdrawal of consent from providing information: You have the right to withdraw or decline your consent to the collection of any User Provided Data at any time, by contacting us in the manner provided in Section 10 of Part A of this Privacy Policy. Please note, that this may affect your usage and access to the DAS Platform.
Communications Opt-Outs: You may opt-out of receiving marketing emails by contacting us in the manner provided in Section 10 of Part A of this Privacy Policy.
Deletion: You may delete your Account by logging into your Account and using the options available therein.
Security and protection of your information:
We use industry-accepted and legally mandated safeguards to help keep the information collected by us secure. These measures include monthly audit review by the SRE, security tools review, periodic reviews of our data collection practices, storage and processing practices, cybersecurity measures such as physical security measures to guard against unauthorized access to systems where we store users’ personal information. We have a comprehensive information security program and information security policies that contain managerial, technical, operational, and physical security control measures adequate for the protection of personal information, including sensitive personal information.
When You register with us, Your User Account is protected by means of a unique password, which is known to or may be accessed only by You. You are responsible for maintaining the secrecy of Your unique User Account details, and for controlling access to emails between You and Mokam, at all times. We are not responsible for the functionality, privacy, or security measures of any other organization. If You become aware of or reasonably suspect any breach of security, including compromise of Your password, You must notify us immediately in the manner provided in Section 10 of Part A of this Privacy Policy.
Information relating to children:
DAS Platform is not intended for or directed at anyone under the age of 18, and we do not knowingly collect or solicit any information from, or allow the registration of, anyone under the age of 18 on the DAS Platform.
Upon learning that we have collected personal information from a user under the age of 18, we will delete that information as quickly as possible. If You believe that a child under the age of 18 may be using DAS Platform, please contact us in the manner provided in Section 10 of Part A of this Privacy Policy.
Third-party platforms and services:
The Platform may contain links to third-party websites or services (“External Resource”). Your browsing on and interaction with any External Resource, irrespective of whether the link to such External Resource originated on the DAS Platform, is subject to the terms and privacy policies of such External Resource. We are not responsible for the functionality, privacy, or security measures of any other entity and this Privacy Policy will not govern Your use and access to such website or service You are redirected to.
